Taking a glance at Mk/bsd.port.mk, the simplest workaround at the moment is
to define make variable PATCH to something other than "/usr/bin/patch", like:
# cd /to/your/favorite/port
# make PATCH=patch install

At least it worked for a simple port like shells/bash .
